Battle of the Forms Explained

Your fine print might be totally useless if the other guy sends his own form back.

This is called the Battle of the Forms. When businesses exchange paperwork with conflicting

terms, it does not always kill the deal. If you accept but add conditions,

that is technically a counteroffer. But if you just ship the goods, you are locked in.

The scary part is the Knockout Rule. If your terms fight their terms, the judge knocks

both of them out. They disappear and get replaced by default laws. You cannot just

sneak in crazy terms that cause hardship and expect them to stick.
